RaceVision Terms of Service & Membership Terms

These Terms of Service and Membership Terms ("Terms") apply to your use of the RaceVision website, services, racing information, predictions, analysis and membership services.

RaceVision is a registered Australian business name operated by The Trustee for Campion Family Trust, ABN 78 869 196 077 ("RaceVision", "we", "us" or "our").

By creating a RaceVision account, starting a free trial, purchasing a membership or using our services, you agree to these Terms.

1. About RaceVision

RaceVision provides racing information, analysis and predictions using racing data, statistical analysis, automated systems and artificial intelligence.

RaceVision may provide information including:

• predicted race selections and finishing order;
• confidence ratings;
• detailed race and runner analysis;
• current or historical racing information;
• bookmaker odds or market information;
• suggested combinations such as quinellas, trifectas and First 4 selections;
• historical prediction performance and accuracy statistics;
• other racing-related information and analysis.

RaceVision currently focuses on Thoroughbred Racing. We may introduce additional racing codes, including Harness Racing and Greyhound Racing.

2. RaceVision is an information and analysis service

RaceVision is not a bookmaker, wagering operator or betting service.

RaceVision does not accept or place bets and does not hold wagering funds on behalf of users.

Our selections, ratings, predictions, suggested combinations, confidence assessments and analysis are provided for information and entertainment purposes only.

RaceVision does not guarantee that any selection will win, place or produce a financial return.

Past performance, historical accuracy, previous results and historical profitability do not guarantee future results or future profitability.

You remain responsible for deciding whether to place a wager, which wagering provider to use, how much to wager and whether wagering is appropriate for you.

3. Age requirement

You must be 18 years of age or older to create a RaceVision account, start a free trial or purchase a RaceVision membership.

By creating an account, starting a trial or purchasing a membership, you confirm that you are at least 18 years old.

We may suspend or terminate an account if we reasonably believe that the account is being used by a person under 18.

4. Accounts

You must provide accurate and current information when creating and maintaining your RaceVision account.

You are responsible for maintaining the security of your login details and for activity occurring through your account.

RaceVision memberships are intended for the individual account holder.

You must not sell, transfer, commercially redistribute or provide systematic access to RaceVision content to another person or business without our permission.

Reasonable personal use across your own devices is permitted.

You should notify RaceVision if you believe your account has been accessed without your permission.

5. Memberships and automatic renewal

RaceVision memberships are subscription services. The applicable membership plan, inclusions, price, billing frequency and any minimum commitment will be displayed before you subscribe.

Unless otherwise stated, a membership is billed monthly in advance and automatically renews for successive monthly periods until cancelled.

Before you subscribe, the checkout or subscription screen will prominently disclose:

• the membership price and billing frequency;
• any applicable free-trial period;
• the date on which the first payment will be taken;
• whether the membership automatically renews;
• the renewal price, or how that price will be determined; and
• how you may cancel.

By subscribing, you authorise our payment provider to charge the applicable membership fee at the beginning of each billing period until your membership is cancelled.

You may cancel at any time through the Manage Membership function in your account.

Cancellation takes effect when the cancellation is successfully processed and confirmation is generated by RaceVision or our payment provider.

Unless otherwise stated, you will generally retain access until the end of the current paid period.

If we increase the price of an existing membership, we will provide reasonable advance notice of the new price and the date on which it will apply. You may cancel your membership before the increased price takes effect.

6. Free trials

Where offered, a free trial is available only to eligible customers and may be limited to one trial per person, account, household or payment method.

Before starting a free trial, the checkout or subscription screen will prominently disclose:

• the duration of the trial;
• the membership price that will apply after the trial;
• the billing frequency;
• the date or event on which the first payment will be taken;
• that the membership will automatically renew unless cancelled; and
• how to cancel.

A valid payment method may be required to start a free trial.

Unless you cancel before the trial ends, the trial will automatically convert to the paid membership identified at signup and your nominated payment method will be charged the disclosed membership fee.

You may cancel during the trial through the Manage Membership function in your account.

Cancellation takes effect when it is successfully processed and confirmation is generated. Cancellation will prevent the trial from converting to a paid membership.

Unless otherwise stated, you will retain access until the end of the trial.

If the trial is extended, materially changed or converted to a different paid plan, we will provide the applicable information before any new or different charge is incurred.

7. Founding Membership

RaceVision offers a limited Founding Membership to the first 250 eligible paying members who obtain a Founding Membership while the offer remains available.

The Founding Membership price is $19.95 AUD per month.

A Founding Member will retain the $19.95 AUD monthly Founding Membership price for as long as their Founding Membership subscription remains continuously active, subject to these Terms.

Founding Members receive access to Thoroughbred Racing at launch.

When RaceVision Harness Racing and Greyhound Racing services are released, access to those racing codes will be included in an active Founding Membership at no additional membership charge.

The features and release dates of future Harness Racing and Greyhound Racing services are not guaranteed.

Cancelling a Founding Membership does not immediately remove access. The member will generally retain access until the end of their current paid period or free trial.

If a Founding Member cancels but successfully reactivates their subscription before the current access period expires and before the subscription has fully expired, their Founding Membership status and $19.95 monthly price may be retained.

If a Founding Membership fully expires and the former member later rejoins RaceVision, the Founding Membership status and $19.95 monthly price are lost. The membership plan and pricing available at the time of rejoining will apply.

Founding Membership status is personal to the member and cannot be sold or transferred.

RaceVision will not intentionally issue more than 250 Founding Memberships under this offer.

8. Payments

Subscription payments are processed by a third-party payment provider. RaceVision does not store complete payment-card details.

You authorise our payment provider to charge the disclosed membership fee to your nominated payment method on each applicable billing date until your membership is cancelled.

Your current plan, price, billing frequency and billing information will be available through your RaceVision account or the payment provider's customer portal.

You should keep your payment details current.

Updating payment details does not itself change your membership plan or cancel automatic renewal.

Prices are displayed in Australian dollars (AUD) unless otherwise stated.

9. Failed payments

If a recurring payment is unsuccessful, our payment provider may retry the payment.

RaceVision currently provides a short payment-recovery period, generally up to 3 days, during which payment may be retried and your access may continue temporarily.

We may suspend or end membership access if payment remains unsuccessful after reasonable attempts to recover the amount.

If the membership fully expires following unsuccessful payment, any membership rights that depend on continuous membership, including Founding Membership status, may be lost in accordance with these Terms.

We will not charge for a membership period that has been cancelled or validly ended.

10. Payment disputes and chargebacks

If you believe a RaceVision payment is incorrect or unauthorised, you may contact support@racevision.com.au so that we can investigate the payment.

You may also have rights to dispute a transaction through your bank, card issuer or payment provider.

RaceVision may provide transaction, subscription, cancellation and account records to our payment provider, bank or card network where reasonably necessary to respond to a payment dispute or chargeback.

Making a genuine payment dispute or exercising a lawful right to seek a chargeback will not, by itself, be treated as a breach of these Terms.

Where there is reasonable evidence of fraud, deliberate abuse of the payment-dispute process or use of a payment method without authority, RaceVision may suspend or terminate the relevant account and take reasonable steps to protect the service and recover amounts lawfully owing.

11. Cancelling your membership

You may cancel your RaceVision membership at any time through the Manage Membership function in your account.

The cancellation process will be reasonably accessible and will not require you to telephone, email or contact support merely to cancel.

Cancellation takes effect when the cancellation is successfully processed and confirmation is generated by RaceVision or our payment provider.

When cancellation is completed:

• future automatic renewal charges will stop;
• you will generally retain access until the end of the current paid period or free trial; and
• no further charge will be incurred for a subsequent membership period, subject to any payment already validly authorised or processed before cancellation took effect.

Cancellation because you changed your mind does not, by itself, entitle you to a refund for the unused part of a paid period.

This does not limit any statutory right to cancel, obtain a refund or claim another remedy.

12. Refunds and statutory remedies

RaceVision does not generally refund an unused portion of a paid membership where a customer simply changes their mind or does not use the service.

This policy does not exclude, restrict or modify any right or remedy available under the Australian Consumer Law (ACL) or other applicable law.

Services supplied to consumers must comply with applicable consumer guarantees, including that they are provided with due care and skill, are reasonably fit for a particular purpose made known to the supplier where the guarantee applies, and are provided within a reasonable time where no time is fixed.

Depending on the circumstances, a customer may be entitled to a remedy including rectification of the service, re-supply, cancellation, a refund, partial refund or compensation for reasonably foreseeable loss or damage.

A refund or other remedy may be available where:

• a payment was taken contrary to the disclosed terms;
• a customer was charged after valid cancellation;
• the service has a major failure;
• the service is not reasonably fit for a particular purpose that you disclosed to RaceVision before purchase and for which you relied on RaceVision's skill or judgment, where the applicable consumer guarantee applies; or
• RaceVision otherwise fails to meet an applicable consumer guarantee.

If RaceVision terminates a prepaid membership for reasons unrelated to a breach of these Terms by the customer, fraud, payment failure or other conduct attributable to the customer, RaceVision will refund the unused portion of the prepaid membership period, subject to applicable law.

13. Racing data, odds and information

RaceVision relies on information obtained from various racing, market and third-party data sources.

Although we take reasonable steps to provide accurate and timely information, racing information can change rapidly.

• runners may be scratched;
• barriers, jockeys, drivers or other information may change;
• track and weather conditions may change;
• odds may move;
• races may be delayed, abandoned or rescheduled;
• official results may be amended;
• third-party information may contain errors or delays; and
• data providers may become temporarily unavailable.

Odds displayed by RaceVision should be treated as indicative unless expressly stated otherwise.

Displayed odds may not represent the price available when you attempt to place a wager.

Always confirm current information directly with the relevant official racing or wagering provider before making a wagering decision.

Racing data, market information and other third-party material may be subject to licences, terms of use and intellectual property rights belonging to the relevant data provider or rights holder.

14. Artificial intelligence and predictions

RaceVision uses automated systems, statistical methods and artificial intelligence as part of its racing analysis.

AI-generated and automated analysis can make mistakes.

RaceVision predictions represent an assessment based on the information available to the system at the time of analysis. They should not be interpreted as statements of fact, guaranteed outcomes or guarantees of financial return.

Different analysis performed at different times may produce different results as racing information, conditions and markets change.

No RaceVision confidence rating represents a guaranteed probability of a runner winning or placing unless expressly stated otherwise.

15. Historical performance and accuracy

RaceVision may publish historical performance information including:

• Top Pick strike rate;
• Top 3 performance;
• quinella, trifecta or First 4 coverage;
• prediction accuracy;
• historical simulated returns; and
• other performance statistics.

We aim to calculate these figures using recorded RaceVision predictions and available race results.

Historical statistics describe past performance only.

They do not guarantee future prediction accuracy or future wagering profitability.

Where simulated wagering results are displayed, RaceVision will endeavour to identify the staking method, odds or dividend basis and other material assumptions used in the calculation.

Performance claims and statistics should be read together with any methodology, qualification or period displayed with them.

16. Responsible wagering

If you choose to wager based partly or wholly on RaceVision information, you should only wager amounts you can afford to lose.

Do not treat RaceVision predictions as guaranteed income, financial advice, an investment strategy or a method of recovering previous wagering losses.

RaceVision encourages responsible use of racing information and responsible wagering.

17. Availability of the service

We aim to keep RaceVision available and functioning reliably, but continuous or uninterrupted availability cannot be guaranteed.

RaceVision may occasionally be unavailable because of maintenance, software updates, hosting outages, third-party API or data-provider outages, internet or telecommunications failures, racing data issues, security incidents or circumstances reasonably outside our control.

We may change, improve, replace or discontinue individual features as RaceVision develops.

Where a significant change materially affects a paid membership, we will take reasonable steps to communicate that change and any applicable options available to affected customers.

18. Intellectual property

Unless otherwise stated, RaceVision owns or is authorised to use the RaceVision branding, website design, software, original analysis and other proprietary material provided through the service.

Your membership gives you a personal, limited right to access RaceVision for your own non-commercial use.

You must not, without permission:

• reproduce substantial amounts of RaceVision content;
• scrape or systematically extract RaceVision data;
• resell RaceVision selections or analysis;
• republish RaceVision content as your own;
• commercially distribute RaceVision content;
• provide a competing service using RaceVision content; or
• attempt to reverse engineer, circumvent or interfere with RaceVision systems.

Nothing in this section claims ownership of third-party racing data, bookmaker information or other material owned by third parties.

19. Acceptable use

You must not use RaceVision to:

• break applicable law;
• attempt unauthorised access to RaceVision systems or other accounts;
• interfere with the operation or security of the service;
• distribute malicious software;
• systematically scrape the service without permission;
• abuse free trials, membership offers or promotional pricing;
• impersonate another person;
• use another person's payment method without authority;
• engage in fraudulent activity.

We may restrict or suspend access where reasonably necessary to protect RaceVision, our users or third parties.

20. Suspension and termination

RaceVision may suspend or terminate an account where there is a reasonable basis to believe that:

• these Terms have been materially breached;
• the account is being used fraudulently;
• membership or trial systems are being deliberately abused;
• the account creates a security risk;
• the user is under 18;
• payment remains unsuccessful and the membership has expired; or
• continued access would breach applicable law.

Where appropriate, we will attempt to provide reasonable notice or an opportunity to resolve the issue.

If RaceVision terminates a prepaid membership for reasons unrelated to the customer's breach, fraud, payment failure or other conduct attributable to the customer, the refund provisions in clause 12 apply.

21. Liability

RaceVision provides racing information, analysis and predictions. RaceVision does not provide guaranteed racing outcomes, financial advice or wagering services.

Racing outcomes are inherently uncertain. A RaceVision prediction, selection, rating, confidence assessment or analysis may be incorrect even where RaceVision has exercised reasonable care in providing the service.

The fact that a RaceVision prediction or selection does not produce the predicted result does not, by itself, establish that RaceVision has failed to provide the service with due care and skill or otherwise breached these Terms.

Customers remain responsible for their own wagering decisions, including whether to wager, the amount wagered and the wagering provider used.

To the extent permitted by law, RaceVision is not responsible merely because a customer incurs a wagering loss after choosing to rely on RaceVision content or because a prediction, selection or suggested combination is unsuccessful.

However, nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights or remedies arising from:

• fraud;
• misleading or deceptive conduct;
• false or misleading representations;
• negligence, to the extent liability cannot lawfully be excluded or limited;
• a failure to comply with an applicable consumer guarantee;
• any other liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

Nothing in this clause prevents a customer from seeking a refund, cancellation, rectification, re-supply, compensation or another remedy where that remedy is available under applicable law.

22. Third-party services

RaceVision uses third-party providers to operate parts of the service, including payment processing, hosting, authentication, email delivery, racing and market data, artificial intelligence and other technology services.

Those providers may have their own terms and privacy policies.

Links to third-party websites or services do not mean that RaceVision controls, operates or guarantees those services.

The availability of third-party services may affect the availability or accuracy of some RaceVision features.

23. Privacy

Our collection, use, storage and handling of personal information is described in the RaceVision Privacy Policy.

RaceVision may use service providers operating in Australia and overseas to provide its services.

24. Changes to these Terms

We may update these Terms as RaceVision develops or where required because of legal, regulatory, technical or business changes.

If a change materially affects an existing paid membership, we will provide reasonable notice where appropriate or required by law.

A change to these Terms does not remove an existing Founding Member's $19.95 monthly Founding Membership price while that member remains continuously subscribed in accordance with clause 7.

The current version of these Terms will be available on the RaceVision website and will display its last-updated date.

25. Governing law

These Terms are governed by the laws applicable in Victoria, Australia.

Nothing in these Terms prevents a consumer from exercising rights available to them under applicable Australian law.
